Trademark Procedures

The Russian Federation follows a "first to register" system. A trademark not properly registered with the Rospatent (the Russian Federation Patent Office) neither provides protection or priority.

Trademark application requirements:

  1. Full name and address of applicant.
  2. List of goods and services in accordance with the International Classification of Goods and Services.
  3. Description of the mark.
  4. Five black and white prints of the mark (or colored prints if it is a color-specific mark).
  5. Power of Attorney.

Application Two-Step Examination:

  1. Formal examination - review the contents of an application and accompanying documents to ensure proper format.

  2. Susbstantive examination - determine whether the mark is registrable based on Russian Federation Trade Mark Law (i.e., distinctiveness, non-confusion with prior similar trade mark registrations, etc...).
