Trademark Procedures
The Russian Federation follows a "first to register" system. A
trademark not properly registered with the Rospatent (the Russian
Federation Patent Office) neither provides protection or priority.
Trademark application requirements:
- Full name and address of applicant.
- List of goods and services in accordance with the International Classification of Goods
and Services.
- Description of the mark.
- Five black and white prints of the mark (or colored prints if it is a color-specific mark).
- Power of Attorney.
Application Two-Step Examination:
- Formal examination - review the contents of an application and accompanying
documents to ensure proper format.
- Susbstantive examination - determine whether the mark is
registrable based on Russian Federation Trade Mark Law (i.e.,
distinctiveness, non-confusion with prior similar trade mark
registrations, etc...).
