Important Changes in the IPR Laws of India

Geographical Indication Act - This Act will provide protection to geographical indications such as place, process, and class of goods. Champagne, Burgundy, Basmati will be treated as geographical indications.

Trade Marks Act - India has become a member of the Patent Cooperation Treaty ("PCT"). Therefore, a priority of six months is provided for trademark applications filed in Paris Convention member countries. An upcoming amendment will also make it possible to register Service Marks.

Patents Act - Under the PCT, India provides one year priority to all patent applications filed in Paris Convention member countries. India is now also a designated state (IN) in the PCT application. Patents for drugs, pharmaceuticals, and agrochemicals will be allowed in 2005. Up until then, protection is provided by way of Exclusive Marketing Rights.
