REQUEST FOR EXTENSION OF TIME TO FILE A STATEMENT OF USE
The Trademark Act provides for extensions of time for filing a
Statement of Use in connection with "intent-to-use" applications.
Initially, an applicant may request a six-month extension of time to
file the Statement of Use by submitting:
- a written request, prior to expiration of the six-month period following issuance of the Notice of Allowance;
- the prescribed fee; and
- a verified statement by the applicant that the applicant has a
continued bona fide intention to use the Mark in commerce, specifying
those goods or services identified in the Notice of Allowance on or in
connection with which the applicant has a continued bona fide intention
to use the Mark in Commerce.
An applicant may request further six-month extensions of time to file the Statement of Use by submitting:
- a written request, prior to expiration of a previously granted Extension of Time;
- the prescribed fee;
- a verified statement by the applicant that the applicant has a
continued bona fide intention to use the Mark in commerce, specifying
those goods or services identified in the Notice of Allowance on or in
connection with which the applicant has a continued bona fide intention
to use the Mark in Commerce; and
- a showing of good cause.
