The scope of patent rights is determined in part by "prior art"; one cannot secure an exclusive right on any invention which is not new, or any invention which is obvious in light of what has gone before. In performing a search, one therefore gains some appreciation for the scope of available patent rights. One may therefore draft an application of appropriate scope, and estimate the economic value of any resulting patent.
